The platform "Sakan and Sakan Holiday”  (the website [www.sakan.co ](http://www.sakan.co /), the Sakan application on Apple, Android, and Huawei stores, and social media accounts under the name "Sakan Online") is owned and operated by Sakan Global General Trading Company (referred to as "Sakan Platform," "System," or "We"). Its purpose is to allow users of the Sakan and Sakan Holiday platform to browse real estate listings. As a user of this platform and service (referred to as "User," "You," or "Yours"), you acknowledge that your use of this platform and service for any reason, including conducting transactions ("Use"), is subject to the terms and conditions outlined below, which include, without limitation, effective links to other related sections such as the homepage, privacy policy, registration, login, about us, contact us, etc. (referred to collectively as "Terms").

 We reserve the right to change these terms and conditions at any time. Any such changes will be effective on the day they are posted on the Sakan and Sakan Holiday platform (see the date at the top of the page). Therefore, you should read the terms each time you use the platform. By entering the Amaken service, registering an account, or using the services provided by Sakan on the platform, you agree to comply with the terms. If you do not agree to all or some of the terms, you must stop using the Sakan and Sakan Holiday platform.

 Terms and conditions for using Sakan Holiday: 

1. It is obligatory to adhere to the teachings of Islamic law in all entered data, whether in offers or member/subscriber data. Any violation will result in the deletion of the offer and may lead to the cancellation of the account. 

2. Subscribing to the platform and service is considered an official authorization from the subscriber to publish real estate listings on the Sakan Holiday platform and an acknowledgment of not violating the laws and regulations of publishing in Kuwait.

3. Agreements or commercial transactions (buying, selling, renting, etc.) between the parties involved in the transaction (the subscriber and agency/individual) are conducted directly without any responsibility or intervention from the Sakan and Sakan Holiday platform. 

Sakan and Sakan Holiday are not responsible for and do not allow: 

- Any offers that do not verify credibility.

- Incorrect or misleading offers.

- Offers with incorrect images.

- Violation of the rights of any other party.

- Copying, modifying, or publishing content for another person without their explicit consent.

- Using personal information belonging to others without their explicit consent.

Sakan and Sakan Holiday platform, or any person participating in preparing, producing, or distributing any material in this service, do not bear any responsibility for any direct or indirect material or moral damage arising from the use or inability to use this service, or from any error, deletion, defect, or inaccuracy of the information it provides, or from any delay or interruption in its broadcast. 

Sakan Holiday provides a translation of the Arabic version of the terms and conditions into English. Nevertheless, it is important to note that the Arabic version holds the sole authority. hIf there is a conflict between the Arabic version and any other translation, the Arabic version shall take precedence as the primary reference. 

Terms for registering a subscriber account on Sakan Holiday: 

1. Enter a valid and active Kuwaiti mobile number. The system does not accept landline numbers, switchboard numbers, or international numbers.

2. Define the type of subscriber (owner/representative of the owner, company/real estate office).

3. Enter the personal or business name of the subscriber. If not desired, the system will automatically choose the term "Property Manager."

4. Do not use inappropriate subscriber names or ambiguous letters or numbers.

5. Choose a suitable password to protect your account. We are not responsible for  the weakness of the password or for others using or hacking it.

6. Subscribers can change their mobile number after registration and after contacting us to verify the validity of the new number.

7. Ensure the accuracy of the entered data and update it regularly.

8. In case of violating the terms of subscriber account registration, the account will be closed if the provided information does not comply with the specified conditions, and all properties listed on the account will be suspended.

9. Subscribers are informed that their contact information (mobile number or email) provided will be published on the Sakan platform, allowing the other party to communicate and complete the business transaction with them. Therefore, the Sakan and Sakan Holiday platform is not obligated to keep this information confidential. Subscribers bear full responsibility for all information provided on Sakan and Sakan Holiday platform. 

Terms for adding a property  on Sakan Holiday platform:  

For an offer to be accepted on the Sakan Holiday platform after being added by the subscriber, the following conditions must be met: 

1. Specify the service type (for rent), property type (apartment/house/commercial/land/other), and the category related to the type.

2. State the rental price.

3. Add the address, consisting of the governorate, city, and plot number. It is recommended to provide a detailed address, including the street, avenue number, building number, and unit number, for an accurate property location on the map.

4. Include at least three clear photos of the property, including an exterior view, without any logos or text.

5. For commercial/investment properties (shop, office, floor, basement, or warehouse), specify the building area. For land, specify the land area. For villas or houses, specify both the land and building areas if available.

6. Provide a clear and comprehensive description of the property, selecting specifications from the system, such as the number of rooms, bathrooms, areas, and other available options.

7. Specify the booking start and end times, cancellation policy, and any additional fees for the reservation.

8. Avoid adding links to websites or social media accounts on the subscriber's profile or property listing page.

9. Ensure the accurate placement of the offer in terms of governorate, region, section, and sub-category. Adherence to credibility in all added offer details is required.

10. In case of violating the offer conditions, the offer will be rejected, and the subscriber must verify and add any missing information. 

Responsibilities and Liabilities: 

Sakan and Sakan Holiday are not responsible for the general property condition. The subscriber must provide accurate images of the properties to be listed on the platform.  Service representatives are authorized to capture and present the property unless notified to stop capturing and schedule another appointment. 

The subscriber is legally and unlawfully responsible for the condition of all properties listed on the Sakan Holiday platform. They are responsible for the accuracy of all offer data and are liable for any material or moral damages resulting from the listing of the second party's properties. 

Conditions for service employee-captured listings: 

1. All previous conditions for adding a property.

2. Add measurements of the property and/or its parts if available.

3. Add a video if available.

4. Add a rough sketch of the property if there is a video and measurements.

Account management conditions: 

1. Subscriptions:

   - The subscription period is one (1) Gregorian year starting from the contract's effective date.

   - The number of available offers depends on the subscription type.

   - The validity of publishing all offers expires with the subscription duration. 

2. Duration of verification and publishing:

   - The maximum duration for verification and publishing is forty-eight (48) hours, starting from the date of adding or modifying the offer for additions or modifications made by the subscriber. The duration is a maximum of three (3) official working days if captured by Sakan employees, starting from the date of capture. 

3. Subscribers can only modify the property price for the published offer and cannot change the original offer or replace it with another property. 

Consequences of violating these conditions:

All financial fees for services on the Sakan and Sakan Holiday platforms are non-refundable. No financial amounts will be reimbursed or compensated to the subscriber. The paid value remains on the Sakan Holiday platform / Wallet and can be reused within the available time frame after meeting the specified conditions.
